Armeense Federatie juicht Franse wet toe
Den Haag, 22 december 2011 – De Federatie van Armeense Organisaties in Nederland (FAON) is blij dat in Frankrijk het wetsvoorstel is aanvaard, waarmee het ontkennen van de Armeense genocide strafbaar wordt gesteld. Het ontkennen van de Holocaust թԹ was in Frankrijk al sinds 1990 strafbaar.
De Armeense Federatie is van mening dat met een dergelijke bepaling een dam wordt opgeworpen tegen de, voor ArmeniթԹ,rs kwetsende, ontkenningspropaganda van de Turkse overheid.
Ook in Nederland wordt dergelijk ontkenningsmateriaal verspreid, op websites, in geschriften en ook in het publiek debat. Voor de slachtoffers en hun nabestaanden levert dat telkens problemen op.

Op basis van het discriminatieverbod in het Wetboek van Strafwet zijn dergelijke uitlatingen in principe al strafbaar in Nederland. Daarbij gaat het niet alleen om թԹ het ontkennen van de Holocaust; ook het ontkennen van de Armeense genocide is strafbaar, zoals voormalig Minister van Justitie destijds heeft aangegeven.

Het initiatief-wetsvoorstel van ChristenUnie Kamerlid Voordewind beoogt een verbetering in de wetgeving, in die zin dat het verbod expliciet duidelijk maakt, dat publieke uitingen, waarbij genocides stelselmatig worden ontkend met de bedoeling mensen te kwetsen of te discrimineren, in Nederland niet kunnen.
Het feit dat de ontkenning (via het discriminatieverbod) al strafbaar is, is tot nu toe voor de meeste partijen het belangrijkste argument om het initiatief wetsvoorstel van ChristenUnie niet te steunen, zoals uit de parlementaire behandeling dit jaar bleek.

Feit is echter, dat ondanks veelvuldige ontkenningen zowel op internet als elders, waarbij tevens ArmeniթԹ,rs vaak worden beschimpt als leugenaars als het om de genocide gaat, het Openbaar Ministerie nog nooit tot vervolging is overgegaan.

De Armennse Federatie FAON hoopt dat de Franse wet voor zowel het Nederlandse parlement als het Openbaar Ministerie aanleiding is, zich nader te bezinnen op een effectieve aanpak van de ontkenning van genocide in Nederland.

Armenian Federation Welcomes French Law
The Hague, 22 December 2011 – The Federation of Armenian Organisations in the Netherlands (FAON) is glad that the French Parliament in large majority has adopted a bill, which makes denial of the Armenian Genocide a crime. Denying the holocaust has been a crime in France since 1990.

The Armenian Federation believes that with such a provision a dam is raised against denial propaganda of the Turkish government, which is painful for the Armenians.
Based on the prohibition of discrimination in the Dutch Penal Code, such statements are in principle already punishable in The Netherlands. This is not only concerning the denial of the Holocaust, but it makes also the denial of the Armenian Genocide punishable, as indicated the former Minister of Justice at the time.

The bill introduced by the Christian Union MP Mr. Voordewind aims to improve the legislation, in the sence that it makes the prohibition explicitly clear, so that it should not be possible in the Netherlands to deny systematically the genocide by public statements with the intention to offend the people or discriminate them.
The fact that the denial (by the prohibition of discrimination) is punishable in Dutch law, was so far for most factions in Dutch Parliament the main argument to not support the bill by Christian Union, as it was clear from the parliamentary debate this year.

The fact is, however, that despite frequent denials from both on the Internet sites and elsewhere, while at the same time the Armenians are often jeered as liars what the Genocide concerns, the the Public Prosecution Service in the Netherlands has never prosecuted against these offenders.

The Armenian Federation FAON hopes that the French law is a reason for both the Dutch parliament and the the Public Prosecution Service to consider closely an effective approach to the denial of genocide in the Netherlands
